1. Compliance with Laws

• Any laws specific to educational services in your region

2. Prohibited Conduct

You must not engage in any of the following activities:

• Violating any applicable laws or regulations
• Infringing on intellectual property rights of Luminary Code or third parties
• Harassing, threatening, or intimidating other users or staff
• Posting false, misleading, or defamatory content
• Attempting to circumvent security measures or access restrictions
• Using our services to distribute malware or engage in phishing
• Engaging in fraudulent activities or unauthorized commercial use

3. Content Guidelines

Any content you submit through our platform, including forum posts, project submissions, or communications, must be appropriate, respectful, and lawful. We reserve the right to remove content that violates these guidelines without notice.

4. Age Requirements

You must be at least 18 years of age to enter into this agreement. If you are under 18, you may use our services only with the involvement and consent of a parent or legal guardian who agrees to be bound by these terms.

1. Indemnification

You agree to indemnify, defend, and hold harmless Luminary Code, its officers, directors, employees, and affiliates from any claims, liabilities, damages, losses, or expenses (including reasonable legal fees) arising from your use of our services, violation of these terms, or infringement of any third-party rights.

2. Privacy and Data Protection

You acknowledge that you have read and understood our Privacy Policy. You are responsible for ensuring that any personal information you provide is accurate and for updating it when necessary. You agree to our collection and use of data as described in our Privacy Policy.

3. Third-Party Interactions

Our courses may reference or link to third-party resources, tools, or services. We are not responsible for the content, accuracy, or practices of these third parties. Any interactions or transactions you have with third parties are solely between you and them.

4. Account Security

You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use or security breach.

Our services are provided "as is" and "as available" without any warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that our services will be uninterrupted, error-free, or secure.

2. Limitation of Liability

To the maximum extent permitted by law, Luminary Code shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use or inability to use our services.

3. Maximum Liability

In no event shall our total liability to you for all damages, losses, and causes of action exceed the amount you have paid to us in the twelve months preceding the claim, or ¥50,000, whichever is greater.

4. Educational Outcomes

We make no guarantees regarding specific learning outcomes, career advancement, employment opportunities, or income potential resulting from completion of our courses. Success depends on numerous factors including your effort, prior knowledge, market conditions, and individual circumstances.

5. Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, labor disputes, governmental actions, or failures of internet service providers or hosting facilities.

1. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of Japan, without regard to its conflict of law provisions. The United Nations Convention on Contracts for the International Sale of Goods does not apply to this agreement.

2. Jurisdiction

You agree that any legal action or proceeding arising out of or relating to these terms or your use of our services shall be brought exclusively in the courts located in Tokyo, Japan. You consent to the personal jurisdiction of such courts and waive any objection to venue.

3. Dispute Resolution

Before filing any formal legal action, you agree to first contact us at info@herbsandvits.com to attempt to resolve the dispute informally. We are committed to working with you in good faith to reach a mutually acceptable resolution.

4. Severability

If any provision of these Terms and Conditions is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

5. Entire Agreement

These Terms and Conditions, together with our Terms of Service and Privacy Policy, constitute the entire agreement between you and Luminary Code regarding your use of our services and supersede all prior agreements and understandings.

6. No Waiver

Our failure to enforce any right or provision of these terms shall not constitute a waiver of such right or provision. Any waiver must be in writing and signed by an authorized representative of Luminary Code.
